Technically, no – a court may grant a divorce without there being one in place. But it is highly recommended that you and your ex sit down and make a separation agreement promptly after you split, ideally with the help of lawyers.

Taking the time to create a comprehensive separation agreement is a key step toward your successful divorce. It usually covers the same topics that will eventually be resolved anyway as part of your divorce proceedings, whether by court or through negotiation, including the division of assets, the entitlement to support, and related matters.
