Yes, in Canada it’s considered to be illegal to record a private conversation, unless at least one of the individuals involved have given their consent.   In the scenario that you describe, if you and another party are having the conversation with each other (and assuming your spouse is not participating), and if neither of you have given consent to being recorded, then your spouse’s conduct would be in breach of the law.
