Yes. A marriage contract is an agreement signed before or after a wedding that provides you and your partner a pre-agreed, personalized set of rules for dividing up your property in the event you may get divorced in the future.

However – as with any other legal contract – a marriage contract is subject to certain requirements before it is considered valid and enforceable. Under Ontario law, a marriage contract must be: 1) in writing; 2) properly signed by of you; and 3) properly witnessed. Oral contracts are not valid.
