What is a simple divorce?
A simple divorce – also called an “uncontested” divorce – is just as the name suggests: It is a straightforward divorce obtained by two spouses who have agreed to get divorced, and who have fully agreed on all the legal issues that arise as part of that process (such as support and child custody).
It is the opposite of a “contested” divorce, which is where the spouses do not agree to all of the divorce-related issues that can arise, and need to participate in court hearings or mediation sessions to get them settled.
In Ontario a simple divorce can be obtained online, completely by-passing the need to go to court. There are still certain procedures that must be followed, and a filing fee that must be paid. The needed Forms to get started are available here: Form 8A: Application (for simple divorce)
