What is the best way to get divorced?
Although there is no one-size-fits-all process for getting a divorce, the best way is the one that is easiest, most amicable, and the cheapest. Typically, this involves a “Consent Divorce”, which means that you and your spouse are proceeding “on consent”, i.e. you have agreed to the Order that you are requesting from the court. This involves negotiating and resolving your issues in advance, whether informally or with mediation, or both.
(Even short of a full Consent Divorce, the next-best way to proceed is always to have the maximum number of issues settled even before you and your spouse hit the courthouse steps; this leaves the court to resolve only what issues remain).
With that said, as paths to divorce go there are several options. The “best” one for you will depend on your own subjective circumstances, and will always be the one that involves the least possible amount of “pain and suffering” for both of you, for your children, and for your pocketbook.
